QUESTION: Will remanufactured toner cartridges void the warranty on my printer and/or copier?

ANSWER: No, it will not
This is a common misunderstanding by a great many printer and copy machine owners. In the past printer and copier manufacturers have threatened to void warranties when end users, like you, use cartridges that are remanufactured. Legislation prohibits these companies from voiding warranties when an end user wants to use a remanufactured cartridge or a cartridge that has not been made by that company. This legislation is called the Magnuson-Moss Warranty Improvement Act and the Sherman & Clayton Antitrust Act and is listed below for you to view.

To enforce a policy such as this is in direct violation of the Sherman & Clayton Antitrust Acts. A company cannot sell a product under the pretense that the consumer must purchase replacement parts, add-ons, etc., from only that particular company. This includes toner and inkjet cartridges that have been remanufactured.

15 Section 2302

No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer's using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name; except that the prohibition of this subsection be waived by the commission if:

1.The warrantor satisfies the Commission that the warranted product will function properly only if the article or service so identified is used in connection with the warranted product, and

2.the Commission finds that such a waiver is in the public interest.

Sherman & Clayton Antitrust Acts

The Sherman Antitrust Act, a basic federal enactment regulating the operations of corporate trusts, was passed by the U.S. Congress in July 1890, The act declared illegal "every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several States, or with foreign nations."

The Clayton Antitrust Act was passed by the United States Congress in 1914 to prohibit certain monopolistic practices then common in finance, industry, and trade. The act covers corporate activities, remedies for reform, and labor disputes. The provisions relating to corporate activities declared illegal such practices as local price-cutting to freeze out competitors, exclusive selling or leasing, and other forms of price discrimination.

These acts make it illegal for any printer manufacturer to require you to use only their brand of supplies or dictate what supplies you can or cannot use. An OEM (Original Equipment Manufacturer), or any other manufacturer, cannot void your printer warranty because you decided to use products other than theirs. To enforce such policies is a direct violation of the Sherman & Clayton Antitrust Acts.   It would be like a car salesman telling you that if you used a brand of gasoline other than what they told you to then they would no longer honor the warranty on your car.  

Don't be bullied or intimidated and don't be afraid to let your service providers or technicians know that you are aware of these laws.  Especially if they try to intimidate you with voiding your warranty for exercising your rights to pick and choose the supplies you want to buy.

Simply stated, manufacturers cannot threaten to void your warranty simply because you didn't use their overpriced cartridges in your printer. Nor can any company, sales associate, or service technician deny you service on warranty for work that would otherwise be covered under warranty simply because you have used a compatible or remanufactured toner cartridge or inkjet cartridge. The Magnuson-Moss Warranty Improvement Act allows you to use remanufactured cartridges, compatible cartridges, refill kits, etc., without fear of having your warranty voided. This is the law - printer manufacturers know the law, technicians and sales persons  also know the law.  

Of course, who can blame them for trying to get you to buy their overpriced cartridges. They make the majority of their money off of you on the very expensive cartridges they sell to you, not on their printers or copiers. To prove this to yourself, figure the cost of your printer. Now determine approximately how many cartridges you use over the life of that printer and/or copier and calculate the cost of all of those cartridges. You will be astonished at how much more you spend on cartridges than you did on the printer itself. Now you understand why the companies have a strong desire and financial interest in trying to keep you tied to using their very high priced cartridges.

Did you know that the printer cartridges you purchase as "new" are often remanufactured?

Look at the carton of certain brands of copier and printer cartridges. You will find a statement that is similar to the following: "Made in China from foreign and domestic components. May contain material collected in the HP Toner cartridge recycling program". Why pay "new" prices for a cartridge that is not new? You can buy a great product at a better price and it will be remanufactured in the USA!

Do remanufactured cartridges function as well as new cartridges?

Yes, they do. You will find these cartridges are filled to capacity with high quality toner.  In some cases we put more toner in your cartridge than the manufacturer of the cartridge had put in.  Also, all cartridges that we remanufacture have had all replaceable internal components replaced - drums, blades, etc., along with being filled to capacity with toner.  With all of the internal parts replaced you are essentially getting a new cartridge, only the shell of the cartridge is not new.  Service technicians and sales people will sometimes try to use scare tactics by saying that remanufactured toner cartridges will damage your machine.  This is just a scare tactic, the remanufactured toner cartridge industry is an established industry not because the cartridges are inferior, they are just as good and are sometimes filled with more toner.  

So, bottom line, you can have confidence in remanufactured toner cartridges, exercise your rights to buy them, use them and do so without fear of having your warranty voided - don't let yourself be intimidated.
